Protection of personal data according to the GDPR
Lupain Properties S.L., in application of the current legislation on data protection of a personal nature, informs that the personal data collected through the forms on the website: www.lupain.com, are included in the specific automated files of users of the services of Lupain Properties S.L.
The collection and automated processing of personal data is aimed at maintaining the commercial relationship and performing tasks of information, training, advice, and other activities specific to Lupain Properties S.L.
These data will only be transferred to those entities that are necessary for the sole purpose of fulfilling the aforementioned purpose.
Lupain Properties S.L. takes the necessary measures to ensure the security, integrity, and confidentiality of the data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing the old LOPD, the new Organic Law 3/2018, of December 5, on Data Protection and Guarantee of Digital Rights (LOPDGDD).
The user may at any time exercise the rights of access, opposition, rectification, cancellation, limitation, and portability recognized in the aforementioned Regulation (EU). The user states that all data provided by him are true and correct, and undertakes to keep them updated, communicating any changes to Lupain Properties S.L.

The personal data provided will be kept for as long as the commercial relationship is maintained or until you request their deletion and for the period during which legal responsibilities may arise from the services provided.

Lupain Properties S.L. is the owner of all copyrights, intellectual, industrial property, 'know-how' rights, and all other rights related to the content of the website www.lupain.com and the services offered therein, as well as the programs necessary for its implementation and related information.
The reproduction, publication, and/or non-strictly private use of the contents, total or partial, of the website www.lupain.com is not permitted without prior written consent.
Intellectual property of the software
The user must respect third-party programs made available by Lupain Properties S.L., even if they are free and/or publicly available.
Lupain Properties S.L. has the necessary exploitation and intellectual property rights of the software.
The user does not acquire any rights or licenses for the service provided, or for the software necessary for the provision of the service, nor for the technical information tracking the service, except for the rights and licenses necessary for the services contracted and only for the duration of the same.
For any action that goes beyond the fulfillment of the contract, the user will need written authorization from Lupain Properties S.L., being prohibited from accessing, modifying, viewing the configuration, structure, and files of the servers owned by Lupain Properties S.L., assuming civil and criminal liability for any incident that may occur on the servers and security systems as a direct consequence of negligent or malicious actions on their part.
Intellectual property of the hosted content
The contrary use of the legislation on intellectual property rights of the services provided by Lupain Properties S.L. is prohibited, in particular:
- The use that is contrary to Spanish law or that infringes the rights of third parties.
- The publication or transmission of any content that Lupain Properties S.L., deems violent, obscene, abusive, illegal, racial, xenophobic, or defamatory.
- Cracks, program serial numbers, or any other content that violates the intellectual property rights of third parties.
- The collection and/or use of personal data of other users without their express consent or contrary to the provisions of Regulation (EU) 2016/679 of the European Parliament and the Council, of April 27, 2016, on the protection of individuals with regard to the processing of personal data and the free movement of such data.
- The use of the mail server of the domain and email addresses for sending unwanted mass mail.
The user is responsible for the content of his website, the transmitted and stored information, the hypertext links, the claims of third parties, and legal actions regarding intellectual property, third-party rights, and the protection of minors.
The user is responsible for compliance with current laws and regulations and the rules related to the operation of online services, e-commerce, copyright, maintenance of public order, as well as universal principles for using the internet.
The user will indemnify Lupain Properties S.L. for the expenses incurred in the imputation of Lupain Properties S.L. in a case where the liability lies with the user, including legal fees and defense expenses, even if a final judicial decision has not been reached.
Protection of hosted information
Lupain Properties S.L. backs up the content hosted on its servers; however, it is not responsible for the loss or accidental deletion of data by users. Likewise, it does not guarantee the complete replacement of the data deleted by the users since said data may have been deleted and/or modified during the time period since the last backup.
The services offered, except for specific backup services, do not include the restoration of content preserved in backups made by Lupain Properties S.L. when this loss is attributable to the user; in this case, a fee will be determined according to the complexity and volume of the recovery, always subject to the user's acceptance.
Data recovery is only included in the service price when the loss of content is due to causes attributable to Lupain Properties S.L..
Commercial communications
In compliance with the LSSI. Lupain Properties S.L. will not send advertising or promotional communications by email or any equivalent electronic communication means that have not been previously requested or expressly authorized by the recipients.
In the case of users with whom there is a previous contractual relationship, Lupain Properties S.L. is authorized to send commercial communications regarding products or services of Lupain Properties S.L. that are similar to those initially contracted with the customer.
In any case, the user may, after verifying their identity, request not to receive more commercial information through Customer Service channels.
